March 14, 2006 The
Lee County Board of Supervisors met on Tuesday, March 14, 2006 at 9:00 A.M.,
at the North Lee County Office Building in Fort Madison. Present: Joe Kowzan, Rick Larkin, George Morgan, Larry Kruse, and Bob
Woodruff. All votes unanimous unless otherwise
indicated. Moved by Larkin, seconded by Kruse, to
approve the Tuesday, March 7, 2006 board minutes. Motion carried. At
9:05 A.M., Chairman Morgan opened a public hearing for the 2006 to 2009
Mental Health Services Plan. Jim Posz, CPC Administrator, gave an overview of
the plan changes. There were no
written or oral comments received by the Board. At 9:07 A.M., it was moved by
Kowzan, seconded by Larkin, to close the public hearing. Roll call:
Kowzan-aye, Larkin-aye, Kruse-aye, Woodruff-aye and Morgan-aye. Motion
carried. Moved by Woodruff, seconded by Larkin, to approve the 2006 to 2009
Mental Health Services Plan. Motion carried. Barb
Clark, Patricia White and Merlin Hellman representing the MH/MR/DD
Stakeholder Committee presented a bi-annual report to the Board. Chairman
Morgan read the following:
PROCLAMATION WHEREAS, Farm
families that raise crop and livestock provide a valuable and important
service by offering consumers safe, abundant, affordable and nutritious food;
and
WHEREAS, Farm families that raise livestock
in Iowa help generate 10 percent of Iowa’s jobs, more than 8 percent of the
state’s Gross Domestic Product and 25 percent of the state’s total industrial
output; and WHEREAS, Livestock
farmers work diligently to be good neighbors and safeguard environmental
quality by meeting and exceeding regulations, identifying good locations for
new livestock barns and using animal nutrients as a valuable fertilizer resource;
and WHEREAS, Iowa
benefits when farm families have an opportunity to grow their farms
responsibly and successfully so they can remain viable on the land and active
in our communities; Now, therefore we, the Lee County Board of
Supervisors, do hereby Proclaim the week of March 19-25 as NATIONAL AGRICULTURE WEEK Recognizing and celebrating the value of responsible livestock farming, the economic importance of the business, the relevancy of the occupation, the many ways it benefits our communities and the hard work of families involved in this noble profession. this were Mike Holtkamp, Coalition to Represent Iowa Farmers; Karl Tweedy,
Lee County Farm Bureau; Russ Steffensmeier, Lee County Cattlemens
Association; Russ Schwartz, Lee County Pork Producers; and Burt Vandenburg,
Lee County Corn and Soy Bean Association. There were no Citizen Comments,
Questions or Concerns. There was no New Business. Moved by Kruse, seconded by Morgan, to
approve the following Resolution: Resolution #2006-32 RESOLUTION
OF THE LEE COUNTY BOARD OF SUPERVISORS WHEREAS,
Annissa Abston is
the owner of a certain building on leased land constituting a 1999 28’ x 80’
Four Seasons double-wide mobile home; and WHEREAS,
Iowa law requires
that tax liens on buildings on leased land be enforced by civil suit; and WHEREAS,
such suit was
instituted as Mary Hoenig, Treasurer of Lee County, Iowa v. Annissa A.
Abston, et al in the Iowa District Court in and for Lee County at Keokuk in
LALA5500; and WHEREAS,
a judgment was
entered in favor of Lee County and against Annissa A. Abston constituting a
first and valid lien superior to the rights of all others in the amount of
$6,726 on February 13, 2006; and WHEREAS,
Annissa A. Abston
proposes to make payments against the judgment and thereby avoid sheriff’s
sale and eviction; and WHEREAS, Annissa A. Abston has tendered the sum of
$3,663 and agrees to make monthly payments in the amount of $100 towards back
taxes and pay all other taxes when due; and WHEREAS, the Lee County Board of Supervisors has the
authority under §445.36, §445.16 and §445.18 to accept partial payments on a
payment schedule; and WHEREAS, the County Attorney of Lee County and the
now Treasurer of Lee County, Mary Koehler recommend the Board accept the
payment plan as proposed. NOW
THEREFORE BE IT RESOLVED that
the Board of Supervisors of Lee County hereby accepts the payment plan
whereby Annissa A. Abston will pay $3,663 down towards outstanding taxes,
sign a promissory note for the remaining balance and make monthly payments
according to that note. The note
shall provide that if any payment is delinquent the entire balance will
become due and owing and the County will be free to proceed with Sheriff’s
sale and execution. A copy of this agreement shall be filed with the
Treasurer of Lee County and a copy provided to Annissa A. Abston. A promissory note shall be executed within
30 days. Dated at Fort Madison, Iowa, this the 14th

Reports: Supervisor Kowzan reported that the Geode RC&D office has moved
to North 3rd Street in Burlington. Supervisor Kruse will be
attending a Quad County Decat meeting. Received and filed the Minutes of
Meeting of January 27, 2006 and February 2006 Monthly Report for the Lee
County Commission of Veteran Affairs. Received and filed a Tax Suspension
Notice for property at 186 Messenger Road, Keokuk. Moved by Woodruff, seconded by Kruse, to
approve the claims for payment. Motion
carried. With
no further action, Chairman Morgan adjourned the meeting at 9:40 A.M. The next meeting of the Board is scheduled
for Tuesday, March 21, 2006, at 9:00 A.M., at the South Lee County Courthouse
