      The Lee County Board of Supervisors met on Tuesday, November 21, 2006, at 9:00 A.M., at the South Lee County Courthouse in Keokuk.

 

      Present: Joe Kowzan, Larry Kruse, George Morgan, Rick Larkin and Bob Woodruff

 

All votes unanimous unless otherwise indicated.

 

Moved by Kowzan, seconded by Larkin, to approve the Tuesday, November 14, 2006 board minutes.  Motion carried.

 

Moved by Kruse, seconded by Kowzan, to approve the following resolution:

RESOLUTION #2006-89

 

      WHEREAS, the Lee County Board of Supervisors is empowered under authority of Section 309.57 of the Code of Iowa to classify Secondary Roads on the area service system to provide for a reduced level of maintenance on some of these roads, and

 

      WHEREAS, the Board of Supervisors, after consultation with the County Engineer, has specified a lower level of maintenance for roads classified as Area Service C, and

 

      WHEREAS, the Board of Supervisors has received a petition signed by landowners adjoining the road requesting that the following road be classified as an Area Service C road:

 

      A portion of 370th Avenue from 190th Street south to 200th Street being more particularly described as commencing at the Northwest corner of Section 22, Township 68 North, Range 3 West, of the 5th P.M., Green Bay Township, Lee County, Iowa, thence south one mile to the Southwest corner of Section 22.

 

      NOW, THEREFORE BE IT RESOLVED by the Lee County Board of Supervisors that a public hearing be held in the Lee County Office Building, 933 Avenue H, Fort Madison, Iowa, on December 5, 2006, 9:08 a.m., at which all interested persons will be given the opportunity to be heard on the proposed establishment of an Area Service C road as described above.

 

Passed and approved this 21st day of November, 2006.

      Moved by Kruse, seconded by Kowzan, to approve a Roadway Maintenance Agreement with the Iowa Department of Transportation for Old Highway 394 and Old Hwy 218, beginning November 2006 and ending May 2007. Motion carried.

 

      Held a discussion with County Treasurer Janet Strunk concerning the driver’s license stations.

 

      Moved by Woodruff, seconded by Kruse, to approve the following resolution:

RESOLUTION #2006-90

 

Resolution to Determine the Number of Deputies for the Treasurer’s Office

WHEREAS, the number of deputies, assistants, and clerks for each office shall be determined by resolution of the board, in accordance with Section 331.903, Subsection 1, Code of Iowa.

NOW THEREFORE BE IT HEREBY RESOLVED THAT, the Lee County Board of Supervisors determines that the total number of deputies for the Treasurer’s office shall be two (2) effective January 31, 2007, and

FURTHER THAT, this resolution replaces any previous determination regarding the number of Treasurer's deputies.

            Moved by Kruse, seconded by Kowzan, to allow County Treasurer Janet Strunk to post 2 clerk positions immediately. Motion carried.

 

      Citizen Comments: Bob Abel, Fort Madison, asked the Board if they would be looking at the number of deputies in other county departments. Chairman Morgan said that the Board would be looking at all departments’ staffing levels at budget time. Abel also asked if the approval of the new clerk positions in the Treasurer’s Office would have any impact on the possible consolidation of the driver’s license stations. Supervisor Woodruff said that with the elimination of the deputy position and the addition of the two clerk positions the Treasurer’s Office would be adequately staffed but with a cost savings.

 

      Moved by Woodruff, seconded by Kowzan, to approve the appointment of Ryanne L. Wood as Central Point of Coordination Administrator, effective December 11, 2006. Motion carried. Her appointment was at the recommendation of Supervisors Kowzan and Woodruff and the current Central Point of Coordination Administrator Jim Posz.

 

Moved by Morgan, seconded by Larkin, to approve the following resolution:

RESOLUTION #2006-91

 

RESOLUTION SETTING A PUBLIC HEARING

 

                     CONCERNING RAUENBUEHLER SUBDIVISION

 

      WHEREAS, The Lee County Board of Supervisors have been asked by the property owners to approve the platting of a certain subdivision in Lee County, Iowa; and

 

      WHEREAS, The Lee County Board of Supervisors is required to hold a public hearing prior to approval of the plat and the waiver of initial platting;

 

NOW THEREFORE BE IT RESOLVED that the following public notice be given and hearing be held in conformance with this notice:

 

NOTICE IS HEREBY provided that a public hearing will be held on Tuesday the 28th day of November, 2006, at 9:02 o’clock a.m. in the Board Room of the South Lee County Courthouse, 25 North 7th Street, Keokuk, Iowa.  That public hearing will concern whether the Lee County Board of Supervisors waive the requirement for lot size, a Preliminary Plat and contours and approve the Rauenbuehler Subdivision Final Plat.

 

NOW THEREFORE, be it resolved by the Lee County Board of Supervisors to approve the Final Plat of the Rauenbuehler Subdivision to the NW¼ of the SE¼ of Sec. 4-T68N-R5W Lee County, Iowa; more particular perimeter description as follows:

 

Part of the West Half of the Northwest Quarter of the Southeast Quarter of Section Four (4), Township sixty-eight (68) North, Range Five (5) West of the Fifth Principal Meridian, in Lee County, Iowa more particularly described as follows: Commencing at the southeast corner of sad Section 4, and running thence North 1113 feet to the center-line of Highway No. 103 between West Point and Fort Madison; Thence North 67° 21’ West 1150.5 feet; thence North 81° 57’ West 930.5 feet; thence South 80.8 feet to the POINT OF BEGINNING; thence South 01° 09’ East 132.5 feet; thence North 86° 15’ West 433.10 feet; thence North 163 feet; thence South 81° 57’ East 414.50 feet to the POINT OF BEGINNING; said described tract containing 1.43 Acres, more or less.

 

The Lee County Auditor is instructed to publish notice of public hearing not less than four nor more than twenty days prior to the date of the public hearing.

      Moved by Kruse, seconded by Morgan, to approve the following promotion for Secondary Roads: Ted Menke, from Truck Driver Class 3A $15.43/hr. to Equipment Operator Class 2 $15.59/hr., effective 11/6/06. Motion carried.

 

      Moved by Woodruff, seconded by Kruse, to approve the following for the Sheriff’s Office: Kristi Gelsthorpe, Correctional Officer/Dispatcher, from $12.26/hr. to $13.23/hr., effective 11/1/06; Evan Bentley, Correctional Officer/Dispatcher, from $12.26/hr. to $13.23/hr., effective 11/1/06; and Part-time new hire Heather Garretson, Correctional Officer/Dispatcher, $11.03/hr., effective 11/13/06. Motion carried.

 

      Received and filed the following step increase for the Health Department: Lori Mehl, Administrative Assistant, from $13.62/hr. to $13.79/hr., effective 11/1/06.

 

      New Business: Chairman Morgan noted that he was in receipt of a letter from Lee County Auditor Anne Pedersen concerning 2 part time election clerk positions. Morgan said that this matter would be discussed at a future workshop.

 

Committee Reports: Supervisor Woodruff reported that a letter was sent to the County Auditor stating due to liability concerns, the Great River Regional Waste Authority office would no longer be used as a polling place. He acknowledged that they had incorrectly estimated the number of people that would be voting at the location since the consolidation of Washington, Green Bay and Denmark Townships.

 

      Received and filed a Class C Beer Permit application from Argyle One Stop, Argyle.

 

      Moved by Woodruff, seconded by Larkin, to approve payment of claims.  Motion carried.

 

With no further business, Chairman Morgan adjourned the meeting at 10:25 A.M.  The next meeting of the Board will be Tuesday, November 28, 2006 at 9:00 A.M., at the South Lee County Courthouse in Keokuk.
