ORDINANCE AMENDING TITLE 1, CHAPTER 16, ENTITLED
“WARDS;
PRECINCTS” BY DELETING SECTION 2
AND
REPLACING IT WITH A NEW SECTION 2;
AND BY
DELETING SECTION 3 AND REPLACING IT
WITH A NEW
SECTION 3
Be it Enacted by the City Council of the City of
Fort Madison, Iowa:
Section 1. The City Council of the City of Fort
Madison, Iowa does hereby amend Title 1, Chapter 16, entitled “Wards;
Precincts” by deleting Section 2 in its entirety and replacing it with a new
Section 2 to read in full as follows:
“1-16-2: WARDS
ESTABLISHED:
The city is hereby divided into five (5) wards as follows:
A. The first ward shall consist of that territory
bounded on a line as follows:
Beginning at the
intersection of the northern corporate limit line and Old Denmark Road;
thence southerly along Old Denmark Road to the intersection of Old Denmark
Road and Old Denmark Hill; thence southeasterly along Old Denmark Hill to the
intersection of Old Denmark Hill and Avenue C; thence west along Avenue C to
the intersection of Avenue C and 10th Street; thence southerly
along 10th Street and its extension to the intersection of 10th
Street extended and the Burlington Northern Santa Fe railroad; thence
westerly along the Burlington Northern Santa Fe railroad to the northwest
corner of Census Tract 9902, Block 2004 (along French Creek); thence
southeasterly to the southwest corner of Census Tract 9902, Block 2004 and
the Mississippi River; thence easterly along the southern corporate limit
line to the eastern corporate limit line; thence westerly along the northern
corporate limit line to Old Denmark Road and the place of beginning.
B. The
second ward shall consist of a territory bounded by a line as follows:
Beginning at the
northern corporate limits at Peavine Lane; thence southerly along Peavine
Lane to the intersection of Peavine Lane and Avenue B; thence easterly to the
intersection of Avenue B and 16th Street; thence southerly along
16th Street to the intersection of 16th Street and
Avenue E; thence westerly along Avenue E to the intersection of Avenue E and
18th Street; thence southerly along 18th Street to the
intersection of 18th Street and the Burlington Northern Santa Fe
railroad (south of Avenue O); thence westerly along the Burlington Northern
Santa Fe railroad (south of Avenue O) to the northwest corner of Census Tract
9902, Block 2038; thence south and east to the southwest corner of Census
Tract 9902, Block 2038 and the Mississippi River; thence easterly along the
southern corporate limit line to the southwest corner of Census Tract 9902,
Block 2004 (along French Creek); thence northwesterly to the northwest corner
of Census Tract 9902, Block 2004; thence northeasterly along the Burlington
Northern Santa Fe railroad to 10th Street extended; thence
northerly along 10th Street and its extension to the intersection
of 10th Street and Avenue C; thence easterly along Avenue C to the
intersection of Avenue C and Old Denmark Hill; thence northwesterly along Old
Denmark Hill to the intersection of Old Denmark Hill and Old Denmark Road;
thence northerly along Old Denmark Road to the intersection of Old Denmark
Road and the northern corporate limits; thence westerly along the northern
corporate limits to Peavine Lane and the point of beginning.
C. The third
ward shall consist of territory bounded by a line as follows:
Beginning at the northwest corner of Census Tract 9911, Block
2023; thence southerly along 24th Street to the intersection of 24th
Street and Avenue H; thence westerly along Avenue H to the intersection of Avenue
H and 26th Street; thence southerly along 26th Street to the
intersection of 26th Street and Avenue L; thence easterly along
Avenue L to the intersection of Avenue L and 25th Street; thence
southerly along 25th Street to the intersection of 25th
Street and Avenue N; thence easterly along Avenue N to the intersection of
Avenue N and 23rd Street; thence southeasterly along 23rd
Street to the intersection of 23rd Street and the Burlington
Northern Santa Fe railroad (along the southwest corner of Census Tract 9902,
Block 2012); thence westerly along the Burlington Northern Santa Fe railroad
to the northwest corner of Census Tract 9902, Block 2024 (along Lost Creek);
thence southerly along Lost Creek to the Mississippi River; thence easterly
along the southern corporate limit to the southwest corner of Census Tract
9902, Block 2038, thence northwesterly along the western border of Census
Tract 9902, Block 2038 to the Burlington Northern Santa Fe railroad (south of
Avenue O); thence easterly along the Burlington Northern Santa Fe railroad to
the intersection of the Burlington Northern Santa Fe railroad and 18th
Street; thence northerly along 18th Street to the intersection of
18th Street and Avenue E; thence easterly along Avenue E to the
intersection of Avenue E and 16th Street; thence northerly along
16th Street to the intersection of 16th Street and
Avenue B; thence westerly along Avenue B to the intersection of Avenue B and
Peavine Lane; thence northerly along the Peavine Lane to the northern
corporate limits; thence westerly along the northern corporate limits to the
point of beginning.
D. The fourth ward shall consist of two
precincts bounded by a line as follows:
1. Precinct 4A
shall consist of territory bounded by a line as follows:
Beginning at the northwest corner of
Census Tract 9901, Block 1000; thence southerly along Crescent Lane to the
intersection of Crescent Lane (30th Street) and Richards Drive;
thence southerly along 30th Street to the intersection of 30th
Street and Avenue H; thence westerly along Avenue H to the intersection of
Avenue H and 31st Street; thence southerly along 31st
Street to the intersection of 31st Street and Avenue L; thence
easterly along Avenue L to the intersection of Avenue L and 30th
Street; thence northerly along 30th Street to the intersection of
30th Street and Avenue K; thence easterly along Avenue K to the
intersection of Avenue K and 27th Street; thence northerly along
27th Street to the intersection of 27th Street and
Avenue I ; thence easterly along Avenue I to the intersection of Avenue I and
26th Street; thence northerly along 26th Street to the
intersection of 26th Street and Avenue H; thence easterly along
Avenue H to the intersection of Avenue H and 24th Street; thence
northerly along 24th Street to the intersection of 24th
Street and the northern corporate limits; thence westerly along the northern
corporate limits to the northwest corner of Census Tract 9901, Block 1000 and
the point of beginning.
2. Precinct 4B
shall consist of territory bounded by a line as follows:
Beginning at the
intersection of Avenue L and 31st Street; thence southerly along
31st Street to the intersection of 31st Street and
Avenue N; thence westerly along Avenue N to the intersection of Avenue N and
32nd Street; thence southerly along 32nd Street and its
extension to the intersection of 32nd Street extended and the
Burlington Northern Santa Fe railroad; thence easterly along the Burlington
Northern Santa Fe railroad to the intersection of the Burlington Northern
Santa Fe railroad and 23rd Street; thence northwesterly along 23rd
Street to the intersection of 23rd Street and Avenue N; thence
westerly along Avenue N to the intersection of Avenue N and 25th
Street; thence northerly along 25th Street to the intersection of
25th Street and Avenue L; thence westerly along Avenue L to the
intersection of Avenue L and 26th Street’ thence northerly along
26th Street to the intersection of 26th Street and
Avenue I; thence westerly along Avenue I to the intersection of Avenue I and 27th
Street; thence southerly along 27th Street to the intersection of
27th Street and Avenue K; thence westerly along Avenue K to the
intersection of Avenue K and 30th Street; thence southerly along
30th Street to the intersection of 30th Street and
Avenue L; thence westerly along Avenue L to the intersection of Avenue L and
31st Street and the point of beginning.”
E. The fifth
ward shall consist of a territory bounded on a line as follows:
All that property in
the corporate limits of the City of Fort Madison, Iowa, which is west of a
line beginning at the northwest corner of Census Tract 9901, Block 1000,
(which is the northern terminus of Crescent Lane); thence southerly along
Crescent Lane to the intersection of Crescent Lane
(30th
Street) and Richards Drive; thence southerly along 30th Street to
the intersection of 30th Street and Avenue H; thence westerly
along Avenue H to the intersection of Avenue H and 31st Street;
thence southerly along 31st Street to the intersection of 31st
Street and Avenue L; thence easterly along Avenue L to the intersection of
Avenue L and 31st Street; thence southerly along 31st
Street to the intersection of 31st Street and Avenue N; thence
westerly along Avenue N to the intersection of Avenue N and 32nd
Street; thence southerly along 32nd Street and its extension to
the intersection of 32nd Street extended and the Burlington
Northern Santa Fe railroad; thence easterly along the Burlington Northern
Santa Fe railroad to the intersection of the Burlington Northern railroad and
Census Tract 9902, Block 2024 (along Lost Creek); thence southerly along Lost
Creek to the Mississippi River, all in Voting District 111011.”
Section
2. The City Council of the City
of Fort Madison does hereby amend Title 1, Chapter 16, entitled “Wards;
Precincts” by deleting Section 3 in its entirety, and replacing it with a new
Section 3 to read in full as follows:
“1-16-3: PRECINCTS ESTABLISHED: The city is hereby divided into five

precincts as follows:
A.. The first ward shall consist of precinct one.
B. The second ward shall consist of precinct
two.
C. The third ward shall consist of precinct three.
D. The
fourth ward shall consist of precincts 4A and 4B.
E. The fifth
ward shall consist of precinct five.”
Section
3. All ordinances or parts of
ordinances in conflict with the provisions of this ordinance are hereby
repealed.
Section
4. If any section, provision, or
part of this ordinance shall be adjudged invalid or unconstitutional, such
adjudication shall not affect the validity of this ordinance as a whole, or
any section, provision, or part thereof not judged invalid or
unconstitutional.
Section
5. This ordinance shall be in
effect after its final passage, approval, and publication as provided by law.
